Our store is hosted on Shopify Inc. They provide us with the online e-commerce platform that allows us to sell our products and Services to you.

These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms of Service, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).

Il contratto stipulato tra Tekworld S.r.l. si intende concluso con l’accettazione - anche solo parziale - dell’ordine da parte di Tekworld Srl. 

 

I prezzi esposti si intendono IVA inclusa. Tekworld Srl si riserva il diritto di accettare o non accettare gli ordini che verranno effettuati e comunque fino ad esaurimento scorte. Nel caso di momentanea indisponibilità dell’articolo ordinato i Sig.ri clienti saranno avvisati tramite e-mail entro un massimo di 5 giorni dal ricevimento dell’ordine d’acquisto.  

 

La Tekworld S.r.l. si riserva il diritto di annullare l’ordine in casi particolari:

 

- errori giacenza magazzino
- irreperibilità del prodotto
- merce andata fuori produzione
- errori di pubblicazione prezzi

 

in questi casi il cliente verrà avvisato tramite e-mail e gli verrà offerto o un prodotto alternativo o sarà annullato l’ordine e gli importi eventualmente versati verranno riaccreditati.  

 

Le fotografie e le schede tecniche sono a carattere puramente indicativo e quindi non vincolanti, la Tekworld S.r.l. non si rende responsabile per eventuali errori o incongruenze (consigliamo di verificare le caratteristiche direttamente sul sito del produttore).

 

L’accettazione si ritiene tacita, se non altrimenti comunicato con qualsiasi modalità al Cliente.

 

Effettuando un ordine su www.tekworld.it il cliente dichiara di aver preso visione, delle condizioni generali di vendita, nelle quali sono specificate:

- procedura d’acquisto
- modalità di pagamento
- consegne
- diritto di recesso-garanzia

Se il Cliente è un consumatore finale (persona fisica che acquista la merce per scopi non riferibili alla propria attività professionale), una volta conclusa la procedura d’acquisto online, provvederà a stampare o salvare copia elettronica e, comunque conservare, le presenti condizioni generali di vendita, nel rispetto di quanto previsto dagli artt. 3 e 4 del Dlgs n. 185/1999 sulle vendite a distanza. 

La Tekworld S.r.l. in quanto venditore online non ha l’obbligo dell’emissione della fattura né dello scontrino fiscale né della ricevuta fiscale al consumatore non intestatario di P. IVA, secondo l’art. 22 del Decreto del Presidente della Repubblica del 26/10/1972 n. 633 e l’articolo 2, lettera oo) del DPR 21 Dicembre 1996, n. 696 (come confermato dalla Risoluzione n. 274/E del 5 novembre 2009). 

Ai fini della garanzia del prodotto acquistato sarà necessario stampare e conservare la ricevuta di consegna scaricabile direttamente dal sito. 

Per le Aziende, liberi professionisti o comunque possessori di P. IVA la fattura elettronica verrà emessa secondo le norme vigenti. Se si desidera comunque ricevere la fattura, anche se non possessori di P. IVA basterà contattare il nostro servizio clienti o inserire la richiesta nelle note dell’ordine. 

Il cliente può acquistare tutti i prodotti presenti nel catalogo Tekworld, la dicitura “disponibile” del prodotto è puramente indicativo in quanto gli acquisti plurimi nello stesso istante da parte di più utenti, può determinare la mancanza del prodotto. Per tale motivo Tekworld si riserva la possibilità, una volta ricevuto l’ordine, di verificare la disponibilità del bene e, in mancanza, di comunicare tempestivamente la mancata accettazione dell’ordine inviato. La Tekworld si impegna a fornire informazioni circa i tempi necessari per la consegna del prodotto ordinato e, su richiesta del cliente, a restituire eventuali somme anticipate oppure a proporre prodotti equivalenti con maggiore disponibilità.

La corretta ricezione dell’ordine è confermata da Tekworld mediante risposta via e-mail, inviata all’indirizzo di posta elettronica comunicata dal cliente, il quale si impegna a verificarne la correttezza e a comunicare tempestivamente eventuali correzioni.

Viene espressamente escluso ogni diritto del Cliente a un risarcimento danni o indennizzo, nonché qualsiasi responsabilità contrattuale o extracontrattuale per danni diretti o indiretti a persone e/o cose, provocati dalla mancata accettazione, anche parziale, di un ordine, o da ritardi di consegna.

Il costo della spedizione è indipendente dalla località e dalla distanza, e varia in funzione del peso e delle dimensioni della merce acquistata. Il costo della spedizione è indicato nel riepilogo d’ordine. I costi di spedizione prevedono un supplemento verso le zone disagiate, le isole minori e le isole della laguna che verrà comunicato dopo il completamento dell’ordine tramite e-mail.

Tekworld copre tutte le proprie spedizioni con assicurazione contro furto, rapina, smarrimento e danneggiamento accidentale durante il trasporto. La merce ordinata viaggerà per corriere espresso.


Tempi di Consegna
Gli ordini di merce immediatamente disponibile vengono preparati e fatti partire generalmente in tre/quattro giorni lavorativi e spediti con corriere espresso che effettua le consegne in 24/48 ore in tutti i capoluoghi di provincia, eccetto località disagiate, isole minori e paesi di montagna.

I tempi di evasione dell’ordine vengono forniti a puro titolo indicativo, non rappresentano in nessun caso un obbligo contrattuale, e potrebbero allungarsi in funzione del numero delle richieste.

Nessuna responsabilità può essere imputata a Tekworld in caso di ritardo nell’evasione dell’ordine o nella consegna di quanto ordinato.


Condizioni di Spedizione
Tekworld può accettare ordini solo con consegna nel territorio dello stato italiano.

Le spese di spedizione sono a carico del Cliente e sono evidenziate al momento dell’effettuazione dell’ordine.

Le spese di trasporto  includono l’assicurazione della merce durante il trasporto.

Il pagamento della merce da parte del Cliente avverrà utilizzando la modalità scelta all’atto dell’ordine.

La merce viaggia con imballo realizzato direttamente dal produttore o in scatole di cartone opportunamente chiuse.

Cosa fare al ricevimento del bene
Al momento della consegna della merce da parte del corriere, il Cliente è tenuto a controllare:

- che il numero dei colli in consegna corrisponda a quanto indicato nella lettera di vettura del corriere
- che l’imballo risulti integro, non danneggiato, né bagnato o, comunque, alterato

Eventuali danni esteriori o la mancata corrispondenza del numero dei colli o delle indicazioni, devono essere immediatamente contestati al corriere che effettua la consegna, apponendo riserva specifica indicando la tipologia del danno o la mancanza di uno o più colli (vedi Accettazione Merce Segnalazione Anomalia)

Ogni segnalazione oltre il termine di 7 gg. non sarà presa in considerazione.

Per ogni dichiarazione, il Cliente si assume la responsabilità piena di quanto dichiarato.


Accettazione merce e Segnalazione Anomalie

 

Danno da trasporto

Cosa fare prima di firmare l’accettazione merce (con il corriere ancora presente).

- Controllare il n° dei colli che si sta ricevendo: deve essere uguale a quello segnalato sul documento di consegna o bollettino di consegna del corriere
- Controllare le etichette apposte sui colli: devono riportare il nome e indirizzo corretto
- Controllare lo stato esteriore dei colli: non devono presentare nessun danno né essere stati manomessi (es. chiusi con nastro non originale ma del trasportatore, imballo danneggiato, ecc.)

Nel caso in cui con i controlli effettuati, si riscontri un’anomalia, firmare lettera di vettura o sul palmare apponendo riserva e specificando il tipo di anomalia riscontrata (esempio riserva per 1 collo mancante – riserva per collo con cartone strappato e bucato).

Attenzione: apporre riserva specifica è un diritto sancito dal codice civile (art. 1698). 

Laddove si accetti indicando “merce integra” nonostante la mancata integrità del collo non sarà possibile ottenere il rimborso.

 

Danno Occulto

Se l’imballo all’atto della consegna non presenta vizi di danneggiamento ma il prodotto all’apertura presenta un danneggiamento fisico, occorre denunciare entro e non oltre 7 gg dal ricevimento del prodotto (art.1698 Codice Civile) il danno al vettore e alla Tekworld, segnalando il problema riscontrato corredato di foto dell’imballo (4 lati) integro, foto del prodotto e una frase tipo “La merce è a disposizione per le perizie assicurative”. 

Le contestazioni pervenute oltre i termini di 7 gg dal ricevimento del prodotto non potranno essere accettate.

Per ogni dichiarazione, il Cliente si assume la responsabilità piena di quanto dichiarato.

Una volta accettata la contestazione al rientro del materiale al nostro magazzino, la merce verrà sostituita o emesso rimborso.

 


Pagamenti

Carta di Credito
È a disposizione dei nostri clienti la possibilità di pagamento con carta di credito (sistema BNL Positivity di BNL per carte Visa Mastercard, Maestro, Masterpass, Mybank)

In caso di pagamenti on-line, Tekworld attualmente usufruisce dei servizi telematici e bancari di BNL per garantire la sicurezza dei pagamenti. La riuscita della transazione, quindi dell’avvenuto pagamento dell’ordine, è data dalla conferma di buon esito direttamente on-line e/o via mail da parte unicamente dei servizi interbancari BNL, senza questa conferma è possibile che la transazione non sia avvenuta e che debba essere rifatta. In questi casi, se dopo 24 ore dal pagamento, non si hanno e-mail neanche da parte di Tekworld riguardo l’evoluzione dell’ordine, è richiesto un contatto di verifica, anche tramite e-mail, da parte del cliente.
Tekworld informa i propri Clienti che un ritardo sulla consegna può comunque prodursi nel caso in cui, per dei motivi di sicurezza, Tekworld necessiti di effettuare una verifica supplementare sui dati di pagamento del cliente. Delle informazioni supplementari potranno eventualmente essere richieste ai Clienti per convalidare definitivamente l’acquisto. Siamo consci dei disagi che ciò può causare ai nostri Clienti ma queste misure sono state adottate per proteggere le transazioni da eventuali frodi a danno dei Clienti stessi.
Con il pagamento tramite carta di credito, l’addebito avviene normalmente entro 60 ore dopo la convalida dell’ordine, a condizione di aver ottenuto l’autorizzazione da parte degli organismi bancari competenti, senza la quale l’ordine sarà considerato nullo.
